Microsoft files restraining order in Motorola patent case

Motorola recently sued Microsoft alleging that Microsoft was infringing on video patents it holds. Microsoft responded by filing an antitrust complaint against Motorola alleging that Motorola was using the patent as a weapon. Motorola is seeking a temporary injunction on products it says are infringing on its video patents that Microsoft produces until the case is heard in court. The problem for Microsoft was the products in question were its bread-and-butter, including Windows and Xbox 360 consoles. Microsoft now has filed a restraining order and put up a $300 million bond in an effort to ward off that injunction and keep its major products on sale. Motorola has already asked for a hearing on April 20. The $300 million bond that Microsoft is putting up is offered to cover damages if Motorola wins the case. If you’ve ever signed up for a forum account or newsletter on the Internet, you have probably run across the ReCAPTCHA system that has you enter characters you see in an image on the screen to prove you’re a real person and not a spammer robot. For some reason, I always have a hard time making out letters in most of the ReCAPTCHA images. Google is now using numbers from home addresses and street signs as part of the ReCAPTCHA system. Google has confirmed that it’s using the little images from its Street View image collection in its spam fighting system. The goal is to improve Google Maps by letting the users identify street names and business addresses. The reason this seems so strange at first glance is that many of us may not realize that other than helping reduce spam, ReCAPTCHA also helps to digitize text and printed materials for Google Books, and Google News archives. Linus Torvalds rains on Microsoft’s patent parade

I’m betting this is really good news for smartphone makers. Open-source poster boy Linus Torvalds stepped up and helped stop a Microsoft patent from being used to choke licensing fees out of other companies. The patent Microsoft owns is being used to force Google Android and Linux handset users to pay licensing fees. Apparently, Torvalds stepped into the arena and helped convince an ITC Administrative LAW Judge named Theodore R. Essex that Microsoft’s patent in question was invalid. The same judge who determined that Motorola had violated four Microsoft patents, including one known simply as the 352 patent. That particular patent has to do with storing filenames with a lot of characters in old file systems like Windows FAT. Torvalds told the judge that Motorola had found the posting he had made about long filenames used in a compatible manner with short filenames, and that post predated the Microsoft patent by three years. HTC One series devices go on sale early in Germany

Three new HTC smartphones are expected to go on sale in Germany, Austria, and Switzerland on Monday, April 2. However, it appears at least one German retail store called Media Market is selling the smartphones early. The photo here is of the HTC One S as seen on the store shelves. The product card clearly shows the eight-megapixel rear camera and Android 4.0 operating system. The phone carries a cash price of €519 as opposed to the MSRP of €499. The S uses a QUALCOMM Snapdragon MSM8260A S4 processor. The HTC One range also has two other smartphones, including the One V and the One X. The store is selling the One X for €579. The X has a 4.7-inch screen, eight-megapixel camera, and runs the Nvidia Tegra quad-core processor. Any of you that live in Germany and buy the device early be sure to let us know what you think.

RIM denies abandoning consumer BlackBerry market

RIM has denied speculation that it is exiting the consumer BlackBerry business to focus on enterprise customers, arguing that it is enhancing business support rather than slashing smartphones for the general public. ”We remain committed to all of our Customers (consumer & enterprise) and are enhancing our support/solutions for enterprise” RIM’s MD of global sales and regional marketing Patrick Spence said today, ”[our] goal is to help our enterprise customers capitalise [sic] on the opportunities presented by consumerization while minimizing risks.” The financial situation at RIM is certainly dire at present. The Canadian company announced a dismal $125m loss in Q4, prompting a spree of executive lay-offs and co-founder Jim Balsillie resigning from the RIM board. However, comments by RIM CEO Thorsten Heins that the company would require “substantial change” in order to right itself, and the concession that “we can’t do everything ourselves but we can do what we’re good at” led to s

GMC talks heads up display technology for vehicles

GMC has offered a bit of insight into the seemingly simple heads up display some of its vehicles such as the 2012 Acadia SUV uses. The heads up display in the car is designed to allow the driver to keep your eyes on the road and still see important details such as what year you’re in, the speed, and RPMs of the vehicle. This is similar to the tech fighter pilot used to keep your eyes ahead at all times. The technology will also indicate other things in the GMC vehicles such as vehicle warnings, outside temperature, turn signal activation, and radio information. The driver can adjust the position on the windshield, the display can be dimmed or brightened, and can be turned off. GMC says that the HUD was designed as part of the instrument panel. The GMC system uses a series of mirrors and a display screen to project the HUD on the windshield. Face.com is claiming that its new API can detect the age of a person in a scanned photo. Using that API, the website has built a pair of Facebook apps that are able scan photos taken automatically. The API is also available to other developers who want to integrate facial recognition into their apps. The app offers minimum age, maximum range, and the estimated age. Apparently, the API isn’t 100% accurate, but it’s close enough to give an approximate age range. The algorithm uses multiple things from a photograph to help determine an age such as if your face is soft and round indicating, a younger age, or more elongated hinting the person is older. The API also looks at other facial features like smoothness and whether wrinkles are present to determine an age. The API is also able to provide a confidence level on how well was able to determine age based on the quality of the image and the way the person’s face is turned in the image. Safety regulators in the US have warned owners of certain BMW 5- and 6-series cars that they should park outdoors after a fire risk in over 367,000 vehicles was identified, though BMW insists only one incident has actually been recorded. The National Highway Traffic Safety Administration (NHTSA) confirmed that a battery cable in certain 2004-2010 BMWs may have been incorrectly attached, with the possibility of overheating and even fire, even when the car is not in use. The issue affects 1.3m cars worldwide. Although issues were first observed back in 2006, BMW says [pdf link], it claims subsequent investigations failed to identify the cause of the problem. The TV is called the X409BV-FHD and falls into the 40-inch category, but has a 38.5-inch viewable image. The set is compliant with the stringent Energy Star 5.3 guidelines so it costs only about $14 a year to run. The TV also has other important features to go along with the energy efficiency. The set features Auto Dynamic Contrast Enhancement to provide better details in dim locations and low-light conditions on-screen. The set has three HDMI ports and a single USB port. Clarion has taken the wraps off a new, Android-powered in-car head unit, the Clarion Mirage, a 6.5-inch touchscreen running Android 2.2 Froyo with a custom UI from Intel owned Wind River. The double-DIN player lacks support for physical media like CDs or DVDs, Paul Tan reports, but does have USB ports and an SD card slot along with Bluetooth for streaming. Although Android is the OS, the USB ports will play nicely with iOS devices and other PMP hardware, allowing owners to pipe through audio from their iPhones and other kit. A Navigon AG powered PND system complete with Garmin data is also on-board. The company is targeting the Mirage at vehicle OEMs – in fact it claims that, while other vendors have offered Android-based head units, such as Parrot’s Asteroid, the Mirage is the first “automotive grade” option - who’ll be able to add various extras in according to buyer whims. RIM may be in turmoil but that hasn’t stopped the company vocally wading into the nano-SIM argument with Apple, joining Nokia in voicing protests over the Cupertino company’s voting tactics for the next-gen card. In a letter sent from RIM to the European Telecommunications Standards Institute (ETSI) this week, the company accuses three Apple employees of re-registering their affiliation, in what RIM suggests is a tactic to further weight the vote toward Apple’s nano-SIM design. “Over the last few days we have observed a number of representatives from one company changing their affiliation over night” RIM wrote in the letter, submitted to the ETSI on Wednesday, “and registering to the meeting not representing their employer or any of their affiliates but representing a completely different company.” The company cites three Apple UK employees who have apparently registered as representatives of Bell Mobility, KT Corp. and SK Telekom, as well as a Vodafone D2 GmbH employee registered as T

A recently released update to the PS3 version of Battlefield 3 was supposed to offer a more enjoyable gaming experience. Instead, what some players are experiencing is random system crashes and glitches that are forcing them to perform hard resets of their console. Developer DICE has faced previous problems with the PS3, as a previously released expansion pack also caused some users to experience game-crippling bugs. The company has not responded to complaints about this latest bungled update, but it is no doubt already working behind-the-scenes to figure out what went wrong. Battlefield 3 came out last year, and publisher EA heralded it as the company’s strongest launch ever. In a matter of days it managed to move 10 million unit sales. Hulu Plus Android tablet support confirmed, scattered

Hulu Plus is finally making its way to the world of Android tablets, but only a few are in the list of supported devices so far. Anyone who watched as the online streaming service was slowly and randomly rolled out to Android phones should know that it might take some time before massive tablet support is enacted, and the next device on the list is anyone’s guess. For now, though, some tablet owners have reason to celebrate. It’s no longer just a 99-cent game download; it’s a wall-busting obsession, and before you know if the mobile gaming industry is weighing in at $7.5 billion! Whew, that was quite a ride. A new study from SuperData (and how can you not believe a company with a name like that?) predicts a very nice rise for the emerging market. The group points to the fact that not only are the number of premium game downloads increasing consistently, but mobile gaming is able to take advantage of other revenue streams as well, like in-game advertising and of course in-app purchases. In fact, already, female gamers from the ages of 25 to 34 are spending an average of nearly $13 every month for mobile game microtransactions. If you needed another indication that mobile payments are PayPal’s future, David Marcus is all the proof you need. Marcus was the top dog in the company’s mobile division, and under his leadership a whole bevy of new mobile initiatives have launched. Now, he’ll oversee the entire Ebay-owned online payment platform. Ebay announced the structural change today, and it means PayPal will continue to steam ahead in this still-nascent market. Marcus knows his stuff when it comes to mobile payment technology. He owned a company called Zong, which specializes in authorizing customers to bill payments to their mobile carrier. PayPal acquired Zong last July, and as part of that deal Marcus began pioneering a lot of big changes for the site. Video game publisher THQ announced today that is has decided to hand pink slips to 118 of its employees across two studios. In the same breath, the company said its upcoming new entry in the Warhammer 40K series, one of its most profitable, will not be a massively multiplayer online game as it originally promised. Instead, it will focus more heavily on a single-player aspect. It is a lesson, of course, that even though games like World of Warcraft look incredibly and irresisistibly profitable, they do actually cost a lot of money, and THQ just wasn’t up for that cost. In the same breath as realizing that HTC’s One X phone has been leaked, we have discovered a video of its brother, the One V. Both are set to make their official debuts shortly, but so far HTC has been rather mum on the new family of Android phones. The One V, just like the One X, was not functional at the Mobile World Congress trade show last month. Thus it has remained cloaked in mystery. A new video, though, from YouTube user welcomechina, shows the device running in its full glory. The video shows a user running through all the basic functionality of the phone – flipping through photos and using multitouch to enlarge and shrink them, scrolling through home screen widgets, and playing music. It’s unclear in what context the video was taken, but it appears to be in the middle of some kind of special event. Apple, Foxconn promise to fix violations found by labor audit

In what’s considered one of the most detailed labor investigations of a Chinese manufacturer, the Fair Labor Association (FLA) has found excessive working times and various health and safety issues at the factories of Apple supplier Foxconn. Foxconn as vowed to rectify the violations and bring all factories up to spec by July 2013. Caught in the midst of a media firestorm over labor practice complaints at its Chinese factories, Apple joined forces with the FLA in January seeking to resolve the issues. The FLA investigation is the first outside labor audit of Foxconn and relied in part on surveys of 35,500 workers that assemble iPhones and iPods at three Foxconn factories in Shenzhen and Chengdu. The investigation has uncovered more than 50 legal or code violations. One of the violations, which is commonly seen in Chinese factories, is a weekly work time exceeding the legal maximum of 49 hours in China. RIM reports dismal Q4 with $125 million loss

RIM under new CEO Thorsten Heins has just announced fiscal fourth quarter earnings results, which, as expected by analysts, continued the company’s losing streak for the fifth time in a row. Furthermore, the company has announced layoffs among its high-level staff and plans to stop issuing financial forecasts. RIM has reported a net loss of $125 million on a revenue of $4.2 billion, a major drop from the $943 million net income and $5.6 billion revenue for the same quarter last year. Its adjusted earnings were 80 cents per share, missing analysts’ expectations for a revenue of $4.56 billion with earnings of 83 cents per share. Analysts estimated that BlackBerry shipments would drop to 11.3 million this past quarter, but RIM managed to do worse, reporting shipments dropping to 11.1 million. BlackBerry devices still outsell the iPhone in emerging markets, but its huge dive in US sales now leaves RIM with only an 8.2 percent share of the global smartphone market. The HTC One X gets its full reveal courtesy of some French gentlemen, who also managed to find the smaller and sleeker HTC One S for some comparison shots. In China and parts of Europe the phone will be available for unlocked purchase on Monday, April 2nd. The HSPA+ version of the phone will cost a cool 599 Euros – about $800 US Dollars. It’s a tempting device even at that price. The One X will be the first smartphone available that uses NVIDIA’s quad-core Tegra 3 architecture, to say nothing of its 4.7-inch 720p screen. Combine that with 1GB of RAM and you’ve got an impressive platform for Android Ice Cream Sandwich, sprinkle4 with version 4 of HTC’s custom Sense UI. Fisker Nina plug-in hybrid caught on camera early

There’s a fabulously sharp looking shiny new car out there in the wild this week, and it goes by the name FiskerNina. This plug-in hybrid vehicle still has few to no details revealed about it, but the absolutely beautiful curves all about it can be seen plainly thanks to a spy who appears to literally be hiding in the bushes to snap some well-placed shots between the leaves. The Fisker Nina is set to be revealed officially next week in New York, but for now we’ll have to peek at leaked shots of the left back and front left corner. The car is said to be powered by BMW four-cylinder engine not unlike what we’ve seen in the top of the line BMW 3 series already revealed for the market at large. Adobe fixes Flash bugs, adds automatic updates

For the second time this month, Adobe has released an update for its Flash Player in order to patch up newly discovered security loopholes. This update addresses two critical memory corruption bugs in Adobe Flash Player 11.1.102.64 that can make your system vulnerable to remote attacks. It also enables future security updates to be automatically downloaded for Windows users. The update fixes two critical memory corruption vulnerabilities that hackers could exploit to remotely take control of your system. An exploit code can be remotely executed on your system if you’re running Windows, Mac OS X, Linus, Solaris, or even some versions of Android. However, this is more of a preventative measure as Adobe is not currently aware of any exploit codes for these two particular bugs being available anywhere at this time. RIM executive lay-offs start today [UPDATE: Balsillie steps down]

The relatively new CEO of BlackBerry’s Research in Motion Thorsten Heins has been reported as heading a series of high-level firings this week before fourth-quarter financial results. This report comes from Canada’s The Globe and Mail who note their source “close to the company” telling of executives at the senior vice-president and vice-president levels being “told they no longer had jobs on Thursday.” This report is not yet confirmed by RIM. The person speaking with TGM noted that both sales and marketing staff were also targeted, this being the same groups targeted for layoffs later this summer. RIM’s BlackBerry-laden fourth-quarter and year-end financial results will be coming soon, this move appearing to be a pre-cursor to a less-than-stellar set of numbers. BlackBerry developer events are reportedly still on for now, but again, no final word from RIM has yet been delivered. We’ll continue letting you know what we know from RIM when we hear it. New plastic bleeds and heals like human skin

Researchers at the University of Southern Mississippi led by Dr. Marek Urban have developed a new type of plastic that has properties inspired by the human skin. When scratched or damaged, the new copolymer turns red as if bleeding and it can heal itself through exposure to sunlight. The plastic is made from more environmentally friendly water-based copolymers that form a molecular bridge in its polymer chains. When the plastic gets scratched or cracked, these bridges break and produce a visible color change. If applied as a thin coating to other layers of plastic, the copolymer could serve in detecting damages and self-healing minor defects. The red splotch that forms when the plastic gets “injured” could help improve safety by drawing attention to those areas so that it can be repaired if the damage is excessive. PSA: Anonymous ‘Internet Blackout’ a false lead

The hacker group known as Anonymous has been tipped to be initiating a project called “GlobalBlackOut” which would hypothetically knock out the vast majority of the HTTP internet. Though the text posted to PasteBin does appear to be an official Anonymous release, setting in motion wheels which would eventually lead to a March 31st attack on the pillars that hold up the greater web, not all is as it seems. Anonymous’ own @anonops Twitter account dismissed the attack as a falsehood last month. This attack could very well be happening in one form or another, but the long and short of the situation is that it’s not a true “Anonymous” attack if one of their main hubs – such as Anonops – says it’s a no-go. Instead what we’ve been tipped on is that this is much more likely a sting attack created by forces that wish to take out “newb” hackers attempting to get in on the fun with no knowledge of the inner workings of Anonymous’ higher ups. Dell kills Venue, Venue Pro, but not US smartphone business

Earlier today it was reported that Dell will be discontinuing its Venue and Venue Pro handsets and pulling out of the US smartphone market. However, Dell spokeswoman Ellen Murphy has responded to PCMag to refute the claims, clarifying that the company has no plans to exit the US smartphone market and will be releasing new smartphones later this year. Dell will no longer be manufacturing the Dell Venue Pro and the Dell Venue, but customers can still purchase the remaining phones from the company’s channel partners in the US. The phones are still being distributed in India and South Korea. The discontinuation was simply attributed to the shorter lifecycles of these type of mobile devices. The Dell Streak handsets previously discontinued in the US are still being distributed in China and Japan. The creators of the hit cartoon series South Park, Matt Stone and Trey Parker, did an interview at the Paley Center in which they revealed some shocking allegations of mis-deeds of the MPAA. This video is one of many in which these two fellows let loose on a variety of groups (as they’re prone to do), but the MPAA clip has begun to gain significant traffic this week as the MPAA finds its name popping up in relation to the Megaupload saga as well as the soon to be released movie “Bully” which will be released without the MPAA’s approval. Whenever I’m at Starbucks, visiting my local mall, or even just driving around town, I find something rather interesting: younger people are nearly always using an Apple product. Now, I’ll fully admit that there are exceptions to the rule and I’m sure that there are countless people out there that can tell me that they are proud BlackBerry and Windows PC owners. But I’m willing to wager that if you sit on a college campus for a day and examine what all the students are using, more often than not, it’ll be an iPhone and a Mac. And when they leave school, those some individuals are using the latest and greatest Apple products. For Apple, that’s a good thing. Those people have literally grown up on the company’s products, and chances are, will continue to use them in the coming years.
